These Product Terms (“Terms”) govern the access to and use of TechClass products and services (“Products”) by customers (“Customer(s)”). By accessing or using any Products, the Customer agrees to be bound by these Terms, which are incorporated by reference into, and supplement, TechClass’s Terms of Service and Privacy Policy.
1.1. License Grant. Subject to compliance with these Terms, TechClass grants the Customer a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Onboarding Training Platform solely for the Customer’s internal employee training purposes.
1.2. User Accounts. Each individual user must be assigned a unique account. Account credentials shall not be shared or transferred between individuals. The Customer shall be responsible for ensuring the confidentiality of account access.
1.3. Customer Content. The Customer shall bear sole responsibility for the accuracy, legality, and compliance of all training materials, data, and other content uploaded or made available on the Platform (“Customer Content”). TechClass disclaims all liability for Customer Content.
1.4. Service Availability. TechClass shall use commercially reasonable efforts to maintain the availability of the Platform, subject to scheduled maintenance, emergency downtime, or events beyond TechClass’s reasonable control.
2.1. Access Rights. The Customer is permitted to grant access to the Training Library to its employees and other authorized learners within the Customer’s organization. Any redistribution, resale, sublicensing, or publication of Training Library content outside the Customer’s organization is strictly prohibited.
2.2. Content Updates. TechClass reserves the right to add, modify, or remove courses within the Training Library in order to maintain the accuracy, quality, and relevance of the content.
2.3. Certificates. TechClass may issue completion certificates to eligible learners who satisfy the course requirements. Such certificates may be used solely for professional or educational recognition purposes.
3.1. AI-Generated Outputs. Certain features may generate automated training materials, assessments, or suggestions through artificial intelligence technologies (“AI Outputs”). The Customer acknowledges and agrees that AI Outputs are provided “as is” and that the Customer shall be responsible for reviewing and approving such AI Outputs prior to reliance or use.
3.2. Data Processing. To enable AI functionalities, TechClass may process anonymized or aggregated usage data. TechClass shall not use Customer Content for the purpose of training third-party artificial intelligence models.
3.3. Limitations of Use. The Customer acknowledges that TechClass AI is intended to assist and augment, and not replace, human decision-making and oversight. TechClass makes no representation or warranty that the use of TechClass AI will achieve any particular result.
4.1. Integration. Certain Products may interoperate with or rely on third-party applications, platforms, or services (“Third-Party Services”), including, but not limited to, cloud hosting, analytics, or payment processing providers.
4.2. Disclaimer. TechClass assumes no responsibility or liability for the operation, availability, or performance of any Third-Party Services, or for the acts, omissions, or failures of third-party providers.
4.3. Separate Terms. The Customer’s use of Third-Party Services is subject to the terms and conditions of the respective third-party providers, which the Customer must review and accept separately.
4.4. Continuity. TechClass does not guarantee the continued availability of any integration or compatibility with Third-Party Services and may modify, suspend, or discontinue such integrations at any time without liability.
5.1. Unless otherwise agreed in writing, all fees for access to the Products shall be payable in advance and are non-refundable.
5.2. The Customer shall be responsible for all applicable taxes, levies, and duties, excluding taxes based on TechClass’s income.
5.3. Failure to pay any fees when due may result in suspension or termination of access to the Products.
6.1. The Products are provided “as is” and “as available.”
6.2. TechClass expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.1. Compliance with Law. The Customer shall ensure that all use of the Products and all Customer Content complies with all applicable laws, rules, and regulations, including, without limitation, data protection and privacy laws (including the GDPR), intellectual property rights, and applicable employment legislation.
7.2. Amendments. TechClass reserves the right to amend or update these Terms at any time. The Customer’s continued use of the Products following such amendments shall constitute acceptance of the updated Terms.
7.3. Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of Finland. The courts of Finland shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
