‍TechClass offers a Learning Management System (“LMS”), self-paced training programs, and related learning solutions to corporate, institutional, and individual clients worldwide. For the purposes of applicable data protection and privacy laws, TechClass shall be regarded as the “data controller” of the Personal Data processed in connection with the Services, unless otherwise expressly stated.

• Performance of a Contract – where processing is necessary to perform our obligations under a contract with the user or the organization granting access to the Services. This includes:
  
  • delivering, operating, and maintaining the Services;
  • managing accounts and authenticating users; and
  • enabling organizations, employers, or institutions to assign, monitor, and track training activities.
• Compliance with Legal Obligations – where processing is required to comply with applicable laws, regulations, or legal processes. This includes:
  
  • complying with statutory, regulatory, or reporting obligations; and
  • responding to lawful requests from public authorities.
• Legitimate Interests – where processing is necessary for the legitimate interests of TechClass or third parties, provided such interests are not overridden by the user’s rights and freedoms. Such legitimate interests include:
  
  • operating, maintaining, and improving the Site and Services;
  • developing new features and offerings;
  • conducting research, statistical analysis, and internal reporting;
  • selecting and managing appropriately skilled suppliers;
  • building and maintaining relationships with partners, institutions, and organizations;
  • carrying out business development and marketing activities (where permitted by law); and
  • performing internal administrative, compliance, and auditing functions.
• Consent – where the user has provided valid consent to the processing of Personal Data. This may include:

 The user may withdraw consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal. Withdrawal of consent may, however, impact TechClass’s ability to provide certain features or Services.

When relying on legitimate interests as a legal basis, TechClass undertakes a balancing test to ensure that such interests are not overridden by the user’s fundamental rights and freedoms.

5. Sharing of Personal Data

TechClass may disclose Personal Data to third parties only in accordance with applicable data protection laws and for the purposes described in this Policy. Such disclosures may include the following:

• Service Providers – to trusted third-party vendors and service providers engaged by TechClass to perform functions on our behalf, including but not limited to hosting, payment processing, analytics, technical support, and customer service. These parties are contractually bound to process Personal Data only in accordance with our instructions and subject to appropriate security and confidentiality obligations.
  
• Customer Organizations – where access to the Services is provided through an employer, academic institution, or other sponsoring organization, that organization may be granted access to certain training-related data, such as course enrollment, progress, completions, assessments, and certifications, for the purposes of monitoring and administering participation in the Services.
  
• Legal and Regulatory Authorities – where disclosure is required to comply with applicable law, regulation, legal process, or enforceable governmental request, or to protect the rights, property, or safety of TechClass, our users, or others.
  
• Partners – in limited circumstances, and only with the user’s prior consent where required, TechClass may share Personal Data with trusted academic or business partners in connection with joint learning initiatives or collaborative programs.

TechClass does not sell Personal Data to third parties under any circumstances.

6. International Data Transfers

As a global provider of learning solutions, TechClass may transfer and process Personal Data in jurisdictions other than the user's country of residence. Where such transfers occur, TechClass implements appropriate safeguards to ensure that Personal Data continues to be protected in accordance with applicable data protection laws. Such safeguards may include the use of standard contractual clauses approved by relevant regulatory authorities, or other lawful mechanisms recognized under local legislation to ensure adequate protection of Personal Data.

7. Retention of Personal Data

TechClass retains Personal Data only for as long as necessary to fulfill the purposes for which it was collected, including the provision of Services, compliance with contractual and legal obligations, the resolution of disputes, and the enforcement of agreements. The applicable retention period may vary depending on the nature of the Personal Data, the contractual relationship, and specific legal or regulatory requirements. Upon expiry of the applicable retention period, Personal Data will be securely deleted, anonymized, or otherwise disposed of in accordance with TechClass’s data retention and deletion policies.

8. Rights of Users

Subject to applicable data protection laws, users have certain rights regarding the Personal Data processed by TechClass. These rights may vary depending on the user’s country or region of residence, but generally include the following:

• Right of Access – to obtain confirmation as to whether TechClass processes Personal Data relating to the user and, where applicable, to receive a copy of such Personal Data.

Please note that in certain circumstances, TechClass may request additional information to verify the identity of the user prior to fulfilling a rights request. Additionally, some requests may be subject to legal or contractual limitations. For example, account deletion functionality may be disabled for users enrolled in for-credit programs or offerings that require the retention of data for compliance purposes. Furthermore, residual copies of Personal Data may remain in backup or archival systems after deletion, though such data will no longer be actively processed.

Residents of jurisdictions with specific privacy frameworks (including the European Economic Area, the United Kingdom, Switzerland, and certain U.S. states with enacted privacy laws) may have additional rights under local legislation. TechClass will honor such rights in accordance with applicable law.

9. Confidentiality and Security of Personal Data

TechClass implements appropriate physical, technical, and administrative safeguards designed to protect Personal Data from unauthorized access, disclosure, alteration, or destruction, in accordance with applicable data protection laws and industry standards. Personal Data will not be disclosed to third parties except as expressly permitted under this Privacy Policy, or where such disclosure is required or permitted by law, including circumstances involving the protection of the rights, property, or safety of individuals.

Notwithstanding these measures, users are advised that no system or method of transmission over the Internet, or method of electronic storage, is entirely secure. Accordingly, TechClass cannot guarantee the absolute security of Personal Data, and there remains a risk that unauthorized third parties may circumvent security measures or that transmissions of information may be unlawfully intercepted.

Users are responsible for maintaining the confidentiality and security of their account credentials, including login information. TechClass specifically cautions that email communications are not typically encrypted and should not be regarded as a secure method of transmitting sensitive Personal Data.

10. Cookies and Tracking Technologies

TechClass and its service providers may use cookies, web beacons, pixel tags, and similar tracking technologies (collectively, “Cookies”) on the Site to enhance functionality, analyze usage patterns, improve performance, and provide a better user experience.
