Beta Program Terms and Conditions

These Beta Program Terms and Conditions (“Beta Terms”) govern participation in any beta programs or pre-release services offered by TechClass (“Beta Services”) and supplement the TechClass Terms of Service, Privacy Policy, and any other applicable agreements (collectively, “Governing Agreements”). By accessing, registering for, or using Beta Services, the participant (“Participant”) agrees to be bound by these Beta Terms.

1. Beta Services Are Pre-Release

1.1 Beta Services are made available solely for evaluation, testing, and feedback purposes. Participant acknowledges and agrees that Beta Services may be incomplete, contain errors, defects, or bugs, and may be unstable or unreliable.

1.2 TechClass makes no representation, warranty, or guarantee regarding the functionality, performance, or availability of Beta Services.

1.3 Participant acknowledges that Beta Services may change, be modified, suspended, or discontinued at any time without prior notice.

2. Confidentiality

2.1 Unless expressly permitted in writing by TechClass, Participant shall treat Beta Services, including all related documentation, materials, features, and technical information, as confidential information (“Confidential Information”).

2.2 Participant shall not disclose, reproduce, transmit, or use Confidential Information for any purpose other than as required to evaluate Beta Services.

2.3 Confidentiality obligations shall survive the termination or expiration of Participant’s access to Beta Services.

3. Feedback

3.1 TechClass welcomes Participant feedback, including suggestions, comments, and improvement recommendations (“Feedback”).

3.2 Participant grants TechClass a perpetual, worldwide, royalty-free, irrevocable, and transferable license to use, modify, reproduce, publish, distribute, and otherwise exploit Feedback for any lawful purpose.

3.3 Participant acknowledges that TechClass may use Feedback without any obligation of compensation or attribution. Feedback that contains Confidential Information of the Participant must be clearly identified as such.

4. Use Restrictions

4.1 Participant shall comply with all applicable laws, regulations, and TechClass’s Acceptable Use Policy when accessing Beta Services.

4.2 Participant shall not, and shall not permit any third party to:

(a) reverse engineer, decompile, or disassemble Beta Services;

(b) attempt to circumvent or disable any security or technical controls;

(c) access or use Beta Services in a manner that could damage, impair, or interfere with the Beta Services or systems of TechClass; or

(d) provide Beta Services to any third party other than Users authorized by TechClass.

5. No Warranty

5.1 Beta Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise.

5.2 To the maximum extent permitted by law, TechClass expressly disclaims all implied warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment.

5.3 TechClass does not warrant that Beta Services will meet Participant’s requirements, operate without interruption, or be error-free or secure.

6. Limitation of Liability

6.1 To the fullest extent permitted by applicable law, TechClass shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, data loss, or business interruption arising from or in connection with the use or inability to use Beta Services.

6.2 This limitation applies even if TechClass has been advised of the possibility of such damages.

6.3 Nothing in this Section shall exclude or limit liability for death or personal injury caused by TechClass’s negligence, or liability that cannot be excluded under applicable law.

7. Data Privacy and Security

7.1 Participant consents to TechClass’s processing of Personal Data in connection with Beta Services in accordance with the TechClass Privacy Policy and any applicable Data Processing Agreement.

7.2 Participant shall not submit Prohibited Sensitive Data to Beta Services. TechClass shall have no liability for Participant’s failure to comply with this requirement.

7.3 TechClass may collect anonymized or aggregated data regarding Participant use of Beta Services for development, research, and improvement purposes.

8. Termination

8.1 TechClass may suspend or terminate Participant’s access to Beta Services at any time, with or without notice, and for any reason.

8.2 Participant may cease participation in the Beta Services at any time by discontinuing use.

8.3 Upon termination or expiration, Participant shall immediately stop using Beta Services and destroy or return any Confidential Information, as requested by TechClass.

9. Intellectual Property Rights

9.1 All intellectual property rights in Beta Services and related materials remain the property of TechClass and its licensors.

9.2 Participant retains ownership of any data provided (“Participant Data”) but grants TechClass a worldwide, royalty-free license to use Participant Data as necessary to provide, evaluate, and improve Beta Services.

9.3 TechClass may use Aggregated Data derived from Participant’s use of Beta Services for internal purposes, product development, research, and marketing, provided that such data is anonymized and does not identify individual Participants.

10. Governing Law and Dispute Resolution

10.1 These Beta Terms shall be governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles.

10.2 Any disputes arising out of or in connection with these Beta Terms shall be submitted to the exclusive jurisdiction of the courts of Finland.

11. Miscellaneous

11.1 These Beta Terms, together with the Governing Agreements, constitute the entire agreement between TechClass and Participant regarding Beta Services.

11.2 TechClass may update or revise these Beta Terms at any time. Continued use of Beta Services constitutes acceptance of the updated terms.

11.3 If any provision of these Beta Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.4 Failure to enforce any provision shall not constitute a waiver of any rights under these Beta Terms.
